NAMD Asks for Medicaid to be Exempt from OIG Pharmacy Rebate Rule

NAMD requested that the Health and Human Services Office of the Inspector General not move forward with including Medicaid plans in a proposed rule exempting negotiated pharmacy rebates from the anti-kickback statute’s safe harbor.

In 2019, the Health and Human Services Office of the Inspector General proposed to significantly change the treatment of managed care plan negotiated pharmacy rebates under the anti-kickback statute. In this letter, NAMD explains why such a change would create significant volatility for state Medicaid programs and likely increase state pharmacy spending. NAMD asked for Medicaid plans to be exempted from this proposal.
