State Associations Request Removal of EVV GPS Ban from 21st Century Cures Act Successor Legislation

NAMD joined our sister state associations in requesting that lawmakers remove a proposed ban on the use of geolocation and biometric features in federally mandated electronic visit verification (EVV) systems as part of the Cures 2.0 draft legislative text.

The 21st Century Cures Act passed in 2016 requires states to adopt electronic visit verification for Medicaid personal care services and home health services, with the implementation date for personal care already past. The recently released draft text of the “Cures 2.0” legislation proposes to modify this mandate by banning the use of geolocation tracking and biometric data in these systems, without changing implementation dates. If enacted, this would create major compliance challenges and costs for states that have already designed and implemented these systems.
