NAMD Requests Extension on Interoperability and Patient Access Rule

On October 7, 2021, NAMD sent a letter to the Centers for Medicare & Medicaid Services (CMS) Administrator Verma requesting an extension of the discretionary enforcement period for the Interoperability and Patient Access regulation.

CMS’ Interoperability and Patient Access regulation implemented new requirements for state Medicaid programs’ health information technology systems. NAMD sent a letter to CMS Administrator Seema Verma requesting a minimum of one additional year of compliance time, with additional flexibility for states demonstrating good faith compliance efforts.

As states grapple with the impact of COVID-19 on state general fund revenues, there is growing concern that this rule’s implementation timelines will create significant strain on already limited Medicaid budgets, as well as state information technology staff and the Medicaid provider community. While NAMD remains supportive of the rule’s overall objectives, the reality of state budget situations requires adjustment in its compliance dates.
