Medicaid Directors are facing the fearsome challenge of preserving their programs in the face of the most serious budgetary crises in decades. One type of action that must be considered is adjustments in provider reimbursement rates. Yet there is substantial uncertainty for states in the Ninth Circuit about the scope of our authority in this area and the applicable legal standards. We are writing to ask your help in resolving these uncertainties, so that we may make informed decisions about provider rates with more secure understanding of the legal requirements we must adhere to.
